Terms of Service
These terms apply when you use the 10thbiz website and apps (the “Service”), operated from the Republic of Korea by 10thbiz (“we,” “us”). By creating an account, you agree to these terms, our Listing Policy and our Privacy Policy.
1. Who can use 10thbiz
- You must be at least 16 years old to sign up.
- Give accurate information when you sign up, and keep your password safe. You are responsible for what happens on your account.
- Use one account. Do not create new accounts to get around a suspension or a block.
2. What 10thbiz does
10thbiz is an online marketplace intermediary. We provide a place where users list pre-owned fashion items, browse, and talk to each other. We are not the seller or the buyer, and we are not a party to any sale between users.
- 10thbiz does not currently process payments. Price, payment and shipping are agreed directly between buyer and seller in messages.
- Offers, including offers on auctions, are messages to the seller. The “highest offer” shown on an auction is set by the seller. A sale happens only when buyer and seller agree to it.
- Customs duties and import taxes are paid by the buyer unless the seller says otherwise.
3. Your content
You own the photos, text and messages you post (“your content”). You must have the right to post it. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, resize and show your content in order to run, improve and promote the Service. This permission ends when your content is deleted, except for copies we must keep by law or that others have already shared.
Listings, your nickname, profile photo and seller page are public. Messages are visible only to the people in the conversation, except when our team reviews a reported conversation as described in the Privacy Policy.
4. Listing and selling
Sellers must follow the Listing Policy, describe items honestly and sell only items they own and are allowed to sell. Sellers are responsible for their listings and for delivering what they sell. Buyers should read listings carefully and ask questions before agreeing to buy.
5. No tolerance for objectionable content or abusive users
10thbiz has zero tolerance for objectionable content and abusive behavior. You must not post, send or do any of the following:
- Counterfeit, stolen or prohibited items
- Scams, fraud or attempts to take payment off agreed terms
- Harassment, threats, bullying or hate speech
- Sexually explicit, violent or otherwise offensive content
- Spam, repeated unwanted messages or misleading links
- Other people’s personal information, or pretending to be someone else
- Content that infringes someone else’s rights
- Collecting data from the Service by automated means, or interfering with how it works
We remove content that breaks these rules and may suspend or permanently ban the users responsible.
6. Reporting and blocking
- Use Report on any listing, auction or chat to tell us about content or a user that breaks these terms. We aim to review reports within 24 hours.
- Use Block in a chat to stop a user from messaging you. Neither of you can send messages to the other until you unblock them.
7. Our actions
We may hide or remove content, restrict features, or suspend or close accounts that break these terms or the Listing Policy, as described in its Enforcement section. We will tell you what we did and how to appeal, unless we must act quickly to stop harm. You can appeal by emailing 2donee@gmail.com within 14 days.
8. Closing your account
You can delete your account at any time in your profile settings (Delete account). This permanently deletes your profile, listings, auctions, conversations and messages. Some records may be kept where the law requires, as explained in the Privacy Policy.
9. Our service
We work to keep the Service running, but it may change, pause or be unavailable from time to time. We may add, change or remove features. The 10thbiz name, logo and design belong to us; do not copy them without our permission.
10. Responsibility
Users are responsible for their own listings, messages and sales. We are not responsible for the quality, safety or legality of items, the truth of listings, or whether users complete a sale, except where the harm is caused by our own intentional act or gross negligence. Nothing in these terms limits rights you have under the mandatory consumer protection laws of the country where you live.
11. Apps
If you use our app downloaded from the Apple App Store, these terms apply together with Apple’s standard licensed application end user license agreement. Apple is not a party to these terms and is not responsible for the app or its content.
12. Changes to these terms
We will post changes and their effective date on the Service at least 7 days before they take effect. Changes that are unfavorable to users will be posted at least 30 days in advance and also sent by email. If you do not agree, you can delete your account before the changes take effect.
13. Governing law and disputes
These terms are governed by the laws of the Republic of Korea. Disputes will be handled by the competent court under the Korean Civil Procedure Act. This does not take away any rights you have under the mandatory laws of the country where you live, including the right to bring a claim in your local courts where that law allows.
